With reference to the matter above.

The National Registration Department (NRD) appreciates and understands En. Mohamad Abdullah from Shah Alam concerned on matters regarding the categorizations of “Illegitimate Child”.

2. For the readers’ information, a child is categorized as Illegitimate when they are born to parents that are not legally married, or when the child are born less than 6 Qamariah month from the date of the ”akad nikah” for Muslim. For babies born out of wedlock to Muslim parents, the child’s name will be put as “bin” or “binti” Abdullah or any Asma Al-Husna (99 Name of Allah).

3. Matters on Section 13, the NRD wish to clarify that it is not a new ruling. It explains on registration for a child born out of wedlock which on the birth certificate shall reflect a remark for Section 13 which indicates that the child is illegitimate child. However, the father’s information will be regarded only as “the person whom acknowledging himself to be the father of the child” as per Provision of Section 13 Registration of Birth and Death Act 1957 (Act 299). The indicator for “Section 13” is only stated in the Birth Certificate but not and never stated on the Mykad.

4. The NRD also would like to explain that the format of Birth Certificate issued from year 1997 to 2008 only required the child to be registered with “name of child” only without ‘bin’ or ‘binti’. Starting from year 2009 when the format of Birth Certificate was introduced, all children must be registered with “full name of the child” which is name of the child which is name of the child with bin or binti to the father’s name. Therefore, any child being issued with the birth certificate from year 1997 to 2008 should not be labeled automatically as illegitimate child. In this case, if they apply for 12 years old identity card, they may use the name exactly the same as stated on the birth certificate. If they wish to have the name written in full, they may request for it at the time of application or later under Regulation 14 – Change of Name and Corrections of Particulars, National Registration Regulations 1990 (for those who not registered under Section 13).

5. Unfortunately the Department was unable to identify which type of document or consent form that was mentioned by En. Mohamad Abdullah, Shah Alam. The NRD wish to convey our regret on the explanation given by the counter staff which has caused inconvenience to En. Mohammad Abdullah.
